Why online mediation?

Online mediation comes with a great number of advantages:

  • Budget and time efficient
    - M
    ediation is characterized as a quick, flexible, low-cost and informal way
    of resolving disputes.
    - It is also a good method to facilitate and move along stalled negotiations.

  • No run-away costs, clogged agendas
    - Each session, with a maximum duration of about an hour, is prepayable.
    The process does not clog the agendas for months to come, costs don't run
    out of control.
    - There are no hidden costs by way of surprise after the process has been
    wrapped up.
    - The costs are in principle borne by the parties in equal part.

  • No open-endedness
    Mediation is not an open-ended process: is has a formal beginning and a
    foreseeable end. The start is marked by acceptance of the Statute and the
    Mediation Agreement. The process is wrapped up by the issue of the Final
    Certificate, irrespective if its outcome.

  • Full confidentiality
    The mediator is independent, neutral, evenhanded and observes the strict-
    est confidentiality. Nothing said, done or produced during the process can
    be used in Court.

  • Beneficial
    The fact alone that both parties have worked together toward a mutual
    solution is enough to improve the relationship considerably.

  • Therapeutic
    M
    ediation also offers the necessary psychological space to come to terms
    with traumatic emotions from the past.

  • Mitigating
    When disputes are anticipated, legal steps cannot yet be taken at that stage:
    the full facts are not yet available and with such steps the conflict would also
    certainly escalate. But early mitigating intervention can still halt the conflict
    from mushrooming beyond control.

  • No watered down compromises!
    Due to the fact that compromises have to be made, in litigation the underlaying
    interests are not always served to the full. Mediation on the other hand serves 
    all aspects the parties themselves bring to the fore. No watered down
    compromises!

  • Acceptability
    A solution to which the parties voluntarily contribute as stakeholders is on the
    long term more acceptable than a result imposed from above. The contributors
    may in fact have achieved something to be proud of!

  • Realism reigns
    Moreover, the result one hopes for through litigation may not always be realistic;
    however convinced you may be of the fairness of your case, a judge may well
    think otherwise ...

In short, it is time to consider mediation. Don't let it escalate...!
